Somi Terms of Service

1. Somi

Somi is an alarm application designed to help users wake up by requiring completion of in-app missions when an alarm rings.

Somi is a tool intended to support personal routines. It does not guarantee that you will wake up, arrive on time, complete a mission, or avoid any consequence of oversleeping. You remain responsible for setting appropriate alarms, maintaining your device, and using backup arrangements where timing is important.

2. Eligibility and use

You may use Somi only in compliance with these Terms and applicable law. If you are below the age at which you can independently agree to these Terms where you live, you may use Somi only with the permission of a parent or legal guardian.

You must not misuse the App, interfere with its operation, attempt to bypass its subscription controls, reverse engineer it except where applicable law permits this, or use it in a way that infringes another person's rights.

3. No account; local app data

Somi does not require you to create an account.

Your alarm, mission, and related in-app settings are stored locally on your device unless otherwise stated in the App. If you delete the App, reset your device, or lose access to your device, locally stored settings and data may be lost.

Our handling of personal data is described in our Privacy Policy, which forms part of these Terms once available in the App and on our website.

4. Subscription required

Somi is a subscription-only app. No free trial is offered, and no App features are available without an active Somi subscription.

The following auto-renewable subscriptions are available:

Both subscriptions provide the same access to Somi; they differ only in billing cadence and price.

Prices shown above are US prices. The price, currency, taxes, and any applicable local charges presented by Apple before purchase control for your purchase.

5. Apple billing, renewal, cancellation, and restoration

Subscriptions are purchased through Apple's In-App Purchase system. Payment is charged to your Apple Account when you confirm the purchase.

Your subscription automatically renews at the end of each billing period unless you cancel it at least 24 hours before the end of the current period. Your Apple Account may be charged for renewal within 24 hours before the end of the current subscription period.

You can manage or cancel your subscription through your Apple Account subscription settings. Deleting the App does not cancel your subscription.

If you cancel, you will retain access through the end of the paid subscription period. You may restore eligible past purchases using the App's Restore Purchases option, provided you are signed in to the relevant Apple Account.

Subscription pricing, availability, renewal, upgrades, downgrades, refunds, and price changes are administered through Apple and are subject to Apple's applicable terms and processes. Where required, Apple will provide notice of, or obtain consent for, a price change.

6. Refunds

Purchases are processed by Apple. Refund requests for App Store purchases are handled by Apple under its applicable policies and procedures. Bedroomlabs does not directly process App Store subscription payments or refunds.

Nothing in these Terms limits any mandatory refund, cancellation, or consumer-protection right that applies to you under applicable law.

7. Availability and changes

We may update, improve, modify, suspend, or discontinue Somi or any part of it, including missions and functionality, where reasonably necessary—for example, to maintain security, comply with law, fix issues, or improve the App.

We will not materially reduce paid subscription access during an active paid period except where necessary for security, legal compliance, or reasons outside our reasonable control. If we discontinue the App or materially reduce its core paid functionality, we will act in accordance with applicable law and Apple's subscription requirements.

We do not guarantee that Somi will be available without interruption, that alarms will always play, or that the App will work in every circumstance. Device settings, battery level, operating-system behavior, network conditions, permissions, and other factors may affect performance.

8. Intellectual property

Somi, including its software, design, content, trademarks, and branding, is owned by Bedroomlabs or its licensors and is protected by applicable intellectual-property laws.

Subject to these Terms and your active subscription, we grant you a limited, personal, non-exclusive, non-transferable, revocable right to use Somi for your personal, non-commercial use.

Except where applicable law permits otherwise, you may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or otherwise exploit any part of Somi without our prior written permission.

9. Feedback

If you send us ideas, suggestions, or feedback about Somi, you grant Bedroomlabs a worldwide, perpetual, irrevocable, royalty-free right to use that feedback without compensation or obligation to you.

10. Disclaimers

Somi is provided on an "as available" basis. To the fullest extent permitted by applicable law, Bedroomlabs disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted availability.

Somi is not medical, health, safety, legal, financial, or professional advice. Do not rely on Somi as your sole method for waking for emergencies, travel, work obligations, medical needs, or any safety-critical purpose.

11. Limitation of liability

To the fullest extent permitted by applicable law, Bedroomlabs will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, opportunities, or business interruption arising from or related to Somi or these Terms.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for intentional misconduct, fraud, death or personal injury caused by negligence where applicable law does not permit exclusion, or your mandatory consumer rights.

12. Informal resolution of concerns

If you have a concern, please contact us first at hi@bedroomlabs.co. We will make a good-faith effort to discuss and resolve it informally.

Nothing in this section prevents you from exercising rights or using remedies that you have under applicable law.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice through the App, on our website, or by another appropriate method before the changes take effect, unless an immediate change is necessary for legal, security, or operational reasons.

Your continued use of Somi after updated Terms take effect means that you accept them. If you do not agree to the updated Terms, you must stop using Somi and may cancel your subscription through your Apple Account settings.

14. Governing law and consumer rights

These Terms are governed by the laws of Romania, without regard to conflict-of-law rules.

If you are a consumer residing outside Romania, you also benefit from any mandatory protections provided by the laws of your country of residence. Nothing in these Terms is intended to deprive you of rights that cannot be waived under applicable consumer-protection law.

15. Apple-specific terms

Where you download Somi from Apple's App Store, these Terms are between you and Bedroomlabs, not Apple. Apple is not responsible for the App, its content, maintenance, support, warranties, or claims relating to the App.

Your use of Somi must comply with the applicable Apple Media Services Terms and Conditions. To the maximum extent permitted by law, Apple has no warranty obligation regarding Somi.

Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you.
